These Terms of Service ("Terms") govern your use of the Agentic platform operated by Clear Site Systems ("Company," "we," "us," or "our"). By subscribing to or using our services, you agree to these Terms.

1. Services

Agentic provides AI-powered digital marketing services including SEO automation, content generation, paid media management, analytics reporting, and outreach services ("Services"). The specific services provided depend on the subscription plan selected.

2. Subscriptions and Billing

• All subscriptions are billed monthly in advance.
• Payment is processed securely through Stripe.
• By subscribing, you authorize us to charge your payment method on a recurring monthly basis.
• All prices are in USD and exclusive of applicable taxes.
• We reserve the right to change pricing with 30 days' notice.

3. Cancellation Policy

• You may cancel your subscription at any time from your account dashboard or by contacting us.
• Cancellations take effect at the end of the current billing period.
• No partial refunds are provided for unused days in a billing period except as described in our 30-Day Results Guarantee.
• There are no cancellation fees.

4. 30-Day Results Guarantee

If you do not see measurable SEO improvements (as defined by our onboarding baseline audit) within your first 30 days of service, you may request a full refund of your first month's payment. To qualify:

• You must have completed our onboarding form within 3 business days of subscribing
• You must have provided all required website access credentials
• Refund requests must be submitted within 35 days of your subscription start date
• The guarantee applies to first-time subscribers only

5. Client Responsibilities

To receive our services, you agree to:

• Provide accurate business information during onboarding
• Grant us necessary access to your website, Google Search Console, and advertising accounts
• Review and provide feedback on content within 5 business days when requested
• Not use our services for illegal, deceptive, or spammy marketing practices

6. Intellectual Property

All content generated by our AI agents for your business becomes your property upon delivery. We retain no rights to use client-specific content for other clients. Our platform, technology, and proprietary processes remain our intellectual property.

7. Limitation of Liability

To the maximum extent permitted by law, Clear Site Systems shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services. Our total liability shall not exceed the amount paid by you in the 3 months preceding any claim.

We do not guarantee specific search engine rankings, as search engine algorithms are outside our control.

8. Confidentiality

We treat all client business information as confidential and will not disclose it to third parties except as required to provide our services or as required by law.

9. Termination

We reserve the right to suspend or terminate service with immediate effect if a client violates these Terms, engages in fraudulent activity, or fails to pay amounts owed.

10. Governing Law

These Terms are governed by the laws of the State of Indiana, United States, without regard to conflict of law provisions.

11. Changes to Terms

We may update these Terms from time to time. Continued use of our services after changes constitutes acceptance of the updated Terms.
